Terms of use
These terms explain how you may use the Archemesh website and our tools, what we promise, and what we expect from you. By ordering or using Archemesh, you agree to them. If something here is unclear, email hello@archemesh.com before you order.
1. Who we are
Archemesh is operated by [Ahmed Roshdy, sole proprietor, Cairo, Egypt / the registered company, once incorporated]. In these terms, “we” means Archemesh and “you” means the business or person that orders or uses our tools.
2. What we provide
We set up, run and monitor automation tools for your business: Reply Desk, Lead Router, AI Assistant and Prospect Research, plus the dashboard that comes with every plan. Each tool has a size (Starter, Growth or Scale) with the limits shown on our Pricing page when you order.
We work with accounts you own, such as your WhatsApp Business account, Instagram professional account, CRM or Google account. You keep ownership of those accounts and everything in them.
3. Orders, invoices and payment
When you build a plan, we issue an invoice, due within 7 days. Your order stays Pending until we confirm your payment. Your subscription starts on the day we confirm it.
Prices are shown in US dollars, or in Egyptian pounds for businesses billed in Egypt and paying through Egyptian payment methods. A setup fee is charged once per order. Bundle discounts and annual billing work as shown on the Pricing page at the time you order.
Promo codes give a discount on the first invoice of an order only, never on renewals. One code per order. A code can have an end date, a limited number of uses, or be limited to new customers, and we may withdraw a code before it is used. If you cancel an order, the code can be used again.
A setup fee is charged once per order, based on the largest size in it. If you add tools or move to a larger size later, you pay only the difference between the new setup fee and the one you already paid.
Subscriptions renew for the same period (monthly or annual) unless you turn renewal off in your settings. We email the renewal invoice 7 days before the period ends, and a reminder on the due date.
If a renewal is not paid, there is a 3-day grace period after the due date. After that your tools are paused (suspended). While suspended you can still sign in, pay the invoice and export your data, and paying restarts your tools.
If a workspace stays suspended for 6 months, we delete it and its data. We email the billing contact 30 days and 7 days before the deletion date. Invoices and payment records are kept for as long as tax law requires, even after deletion.
[Taxes: state whether prices include VAT or other taxes for each billing country.]
4. Limits and fair use
Each size has a monthly limit, for example a number of automatic replies or new leads. Limits are soft: your tools keep working if you go over. We tell you at 80% of your limit. If you go over two months in a row, we will suggest the next size. We never charge you extra without your agreement.
AI usage needed to run your tools within your size is included. Fees that third parties charge you directly, such as Meta's fees for certain WhatsApp messages, are not included.
5. Your responsibilities
You must have the right to use every account and every contact you connect, and you are responsible for the content of the answers you give us to use.
You must follow the rules of the platforms you connect, including Meta's Platform Terms and WhatsApp Business policies. Our tools only reply to people who contacted you, inside the time windows those platforms allow. You may not use Archemesh to send spam, to message people who did not agree to hear from you, or for anything unlawful, harmful or deceptive.
For WhatsApp, Instagram and Facebook, you may create and own the Meta developer app that connects your accounts, following our guide. You remain the owner of that app and you authorise us to operate it on your behalf as your service provider.
Where a tool talks to the public automatically, you agree to make it clear that the reply is automated where the law requires it.
6. Changes to your setup
Once your setup works, we lock it so it cannot break by accident. You can request changes from your dashboard. Small changes (new answers, rules or wording) are included every month, by your plan size. Larger changes, new integrations or custom work are quoted separately.
7. Reliability
We work hard to keep every tool running and we monitor them. We do not promise 100% availability, because the services we connect to (such as Meta, Google or your CRM) can also fail or change. When something breaks, we work to detect and fix it quickly and we tell you what happened.
[Service credits: if offered, state the uptime target per size and the credit.]
8. Cancelling
You can turn renewal off at any time in Settings > Billing preferences, or by email. Your plan stays active until the end of the period you already paid for, then ends without further invoices. Setup fees and paid periods are not refunded, except where the law requires it [confirm refund rules for each market].
You can export your data at any time from Settings > Data & privacy. If you ask us to delete your workspace, we confirm by email and delete it within [7] days. A plan that ends without renewal is treated like a suspended workspace: your data is kept for 6 months so you can return, then deleted after the 30-day and 7-day warnings. Invoices are kept as the law requires.
9. Liability
Our tools help your team answer and follow up. They do not guarantee sales or results. To the extent the law allows, our total liability to you for any claim is limited to the amount you paid us in the [3] months before the claim. We are not liable for indirect losses such as lost profits.
[Lawyer: confirm wording and enforceability for Egypt, the UAE and Saudi Arabia.]
10. Changes to these terms
If we change these terms, we will tell you by email at least 30 days before the change applies to your current plan.
[Governing law and courts: to be confirmed with a lawyer.]
